Maysville Police investigated an accident on Forrest Ave. that occurred around 1 pm today.
The cause of the accident is unknown at this time.

Wreck as a hit and run.. The White dodge pickup was parked, unoccupied. A 30's year old white male was seen walking away from the scene. Police found the driver of the blue car a block south of the original wreck scene. No one was injured.Offending male was cited and released for:
Leaving the scene of an accident.
No insurance.
Driving on a suspended license. (Ohio)

Why was he not arrested for DUI? I was there and saw an open can of Coors Light in the cup holder. And where is the woman that was in the car?
Just curious.

Witnesses said that there was no woman, even the offender stated as such. And as far as the DUI goes. He was NOT intoxicated. Not even by juvenile standards. Therefore Officer's had no probable cause to arrest.
Yes there was alcohol in the car. Two cans of 16 oz beer. One full and cold and the other, over half was spilled on the front floorboard. I was there also.

I thought it was illegal to have an open container in a vehicle? Not trying to start an argument, just wondering.

It is illegal. It is a minor misdemeanor a traffic ticket. You don't go to jail for an open container by itself.
Seems the charges they have him on far outweigh exchanging them for a basic traffic ticket.

I wasn't suggesting that he needed to go to jail that is not my call. I was just commenting on the fact that he was not charged with an open container. I don't think they should exchange any charges, seems this would be another charge.
With all the talk of the "troubled youth" in Maysville, it would seem that this is a case where he should have been charged with that as well. (By the way I was there too)

Not saying you wasn't there, I read that you where in the above post. Did you stay to give a statement?
A $50 ticket is just odd to be the focus when the other charges are just so much greater. I can see about 3 other charges they could have piled on him, like driving on the wrong side of the road. I think they got the job done the right way and the fair way.

Fair enough. I offered a statement but was told that they had enough evidence and statements and didn't think it was necessary.
I am glad he got charged with the other things he did wrong, and I also agree that if there were other charges that could have been brought against him, maybe they should have.

Now in my opinion if you pile on too many small charges some defense attorney is more likely to plea out the bigger for the smaller. Happen all the time.

Fair?? How is that fair? My friend had an open container in the bed of his pick up truck that someone threw in there, and he got a ticket for an open container. It was not his, nor anyone else he knew, he don't even drink. He is a good Christian man. What's fair about picking and choosing what charges who gets?

Different circumstances I am sure. Cops are supposed to have a reason to pull you over, since you did not specify what your friend was pulled over for and go into any detail there is no reason to keep dragging this out.

Trust me... Ask Brian, Kate or any other attorney on here. Police "stacking" charges on a defendant win the police no points with either attorney or the judge. In hind site maybe the officer should have charged his with this petty, State money making offense. But considering the other charges which if combined, the offender could face up to 2 years in County and over 1500 dollars in fines, seems pretty petty.
I'll let this go now, I was just trying to inform, but it's obvious that when I post here it always become some sort of heated debate.

Law enforcement officers in KY have many many rules that they must abide by. That includes rules for charging for offenses. Simple violations must occur in an officer's presence to be charged. Most misdemeanors must occur in an officer's presence to be charged by that officer on the spot as well, although there are some exceptions like shoplifting, DUI, and domestic assault. There are many rules and let's not forget that an officer will be allowed to use his/her own discretion in many cases. I wasn't there, therefore, I would NOT second the officers that WERE there and exercised their judgement.

Knowing the Maysville police officers as well as I do i'm sure the right call was made. More charges means more fines. Check out the show cause docket some time in District Court, most people have got unpaid fines a year or more old. What happens when they don't pay or show up in court? A bench warrant gets issued and more than likely the tax payers will foot the bill to have them brought back here.
