FRANKFORT - Electioneering near a polling place on Election Day would
once again be prohibited under a bill passed by the House Committee on
Elections, Constitutional Amendments & Intergovernmental Affairs.
House Bill 26, sponsored by Rep. Adrian Arnold, D-Mount Sterling, would
prohibit electioneering within 300 feet of any polling place statewide.
The bill as originally filed mandated a 100-foot ban, but an amendment
proposed by Rep. Gross Lindsay, D-Henderson, expanded it.
The current state law requiring a 500-foot ban was declared
unconstitutional in federal court. November's election were held without
a statewide regulation, although some local governments passed
ordinances creating their own perimeters. Those local ordinances would
still be allowed under the proposed law, but the minimum of 300 feet
would be enforced statewide.
The bill now moves to the full House for its consideration.
